You work hard. You pay taxes withheld from every paycheck. At tax season, you want to file properly, claim any refund you are owed, and avoid trouble with the IRS. But you do not have a Social Security Number, and the whole system seems designed for people who do.
You are not alone. Thousands of immigrant workers in Syracuse and across New York State file taxes every year using something called an Individual Taxpayer Identification Number, an ITIN. This number lets you participate in the tax system legally, build financial history, and often claim significant refunds that put money back in your pocket.
But the rules changed recently. What worked last year might not work this year. Some credits you claimed before are no longer available to ITIN holders. Others remain open. Understanding the difference between ITIN and SSN requirements in 2025 can mean thousands of dollars gained or lost.

What Is an ITIN, Really?

An Individual Taxpayer Identification Number is a nine-digit number issued by the IRS to people who need to file taxes but cannot get a Social Security Number. It looks similar, starts with 9, has nine digits, but functions differently.
The ITIN does not authorize you to work. It does not change your immigration status. It does not make you eligible for Social Security benefits. Its only purpose is tax processing, allowing the IRS to identify you, track your tax payments, and issue refunds if you overpaid.
You apply using Form W-7, submitting proof of identity and foreign status. Processing typically takes 7 to 11 weeks, though tax season delays can stretch this to 12 to 15 weeks. Once issued, your ITIN remains valid as long as you file a tax return at least once every three years.
For many Syracuse immigrant families, the ITIN represents the first step toward financial participation in their new country. It creates a paper trail of work and tax compliance that matters for future immigration proceedings. It opens doors to bank accounts, business licenses, and credit history. But its limitations matter too, especially regarding tax credits.

What Changed in 2025: The New Rules You Must Understand

Congress passed legislation in 2025, sometimes called the One Big Beautiful Bill or Working Families Tax Cut Act, that significantly restricted which tax benefits ITIN holders can claim. These changes affect your 2025 tax return, which you will file in early 2026.
Previously, some credits allowed mixed filing, where parents with ITINs could claim benefits if their children had Social Security Numbers. That has changed for several major credits.
Child Tax Credit: Now Requires SSN for Parents and Children
The biggest change hits families with children. To claim the Child Tax Credit or Additional Child Tax Credit in 2025, both the parent and the qualifying child must have valid Social Security Numbers.
Previously, only the child needed an SSN. Now, if you file using an ITIN, you cannot claim the Child Tax Credit even if your U.S.-born children have Social Security Numbers .
For married couples filing jointly, at least one spouse must have an SSN to qualify. If both spouses have only ITINs, the Child Tax Credit is unavailable regardless of the children’s status.
This is a harsh change for many Syracuse families. The Child Tax Credit provides up to $2,000 per qualifying child under 17. Losing this credit can reduce a family’s refund by $4,000, $6,000, or more depending on family size.
Earned Income Tax Credit: SSN Required for All Claimants
The Earned Income Tax Credit has long required valid Social Security Numbers for the taxpayer, spouse, and any qualifying children. This rule did not change in 2025, but it remains a critical limitation for ITIN holders.
The EITC is one of the most valuable credits available, worth up to $7,830 for families with three or more children in 2025. For low and moderate-income workers, this credit often exceeds the total tax liability, resulting in substantial refunds. But without an SSN, you cannot claim it.
Credit for Other Dependents: Still Available to ITIN Holders
Not all credits disappeared. The Credit for Other Dependents remains available to ITIN filers. This non-refundable credit provides $500 per dependent who does not qualify for the Child Tax Credit, typically because they are too old (17 or above) or do not have the required SSN themselves.
While smaller than the Child Tax Credit, this $500 per dependent still reduces your tax bill and can result in refunds if it exceeds your liability.
Education Credits: Now Restricted
The American Opportunity Tax Credit and Lifetime Learning Credit, which help with college and vocational education costs, now also require valid Social Security Numbers for both the student and the taxpayer claiming the credit. ITIN holders can no longer claim these benefits.

What ITIN Holders CAN Still Claim

Despite the restrictions, filing with an ITIN remains valuable and legally required if you have taxable income. Several important benefits remain available:
Credit for Other Dependents
As mentioned, $500 per qualifying dependent remains claimable with an ITIN.
Child and Dependent Care Credit
If you pay for childcare so you can work or look for work, you may claim this credit using an ITIN. You will need to provide the caregiver’s SSN or ITIN as well.
Premium Tax Credit
Under the Affordable Care Act, ITIN holders may claim Premium Tax Credits to help pay for health insurance for family members eligible for coverage.
State Tax Credits
New York State offers several credits that may remain available to ITIN filers even when federal credits are restricted. These vary by year and program, so professional guidance helps maximize your state refund.
Building Financial History
Beyond immediate credits, filing with an ITIN creates documented proof of your work history, income, and tax compliance. This matters for future immigration applications, business loans, and eventually obtaining legal status that may lead to an SSN.

The Path from ITIN to SSN

Many ITIN holders eventually qualify for Social Security Numbers through employment authorization, permanent residency, or other immigration pathways. Once you receive an SSN, you should stop using your ITIN immediately.
The SSN unlocks the full range of tax credits, Child Tax Credit, EITC, education credits, and more. For families who have been claiming limited credits with an ITIN, obtaining an SSN often results in dramatically larger refunds.

Step-by-Step: Getting Your ITIN in Syracuse

If you need an ITIN for the first time, here is exactly how we help you obtain it:
Step 1: Determine If You Actually Need an ITIN
Do you have taxable income but no SSN? Are you a nonresident alien required to file a U.S. return? Are you the spouse or dependent of someone filing taxes? If yes to any, you likely need an ITIN.
Step 2: Gather Identification Documents
The IRS accepts several documents to prove identity and foreign status. Your valid foreign passport is the best option, it proves both requirements in one document. Alternatives include national ID cards, foreign driver’s licenses, birth certificates, and others, though these may require additional documentation.
Step 3: Complete Form W-7

Step 4: Submit With Tax Return (or Through CAA)
You have three options: mail your W-7 with your tax return to the IRS in Austin, Texas; visit an IRS Taxpayer Assistance Center in person; or work with a Certifying Acceptance Agent (CAA).

Myth: I cannot file taxes without a Social Security Number
False. The ITIN exists specifically for this situation. Millions of people file legally every year using ITINs.
Myth: Having an ITIN means I can work legally
False. The ITIN is for tax purposes only. It does not authorize employment or change your immigration status.
Myth: I should not file if I owe money and cannot pay

Your spouse has an SSN through employment authorization; you have an ITIN. Your two children have SSNs. Filing jointly, your spouse claims the Child Tax Credit for both children, up to $4,000. Your ITIN does not block this credit because your qualifying spouse has the required SSN.
Scenario 4: Future SSN Recipient
You currently have an ITIN but applied for adjustment of status. Your SSN arrives in March 2026. We amend your 2025 return to claim the full Child Tax Credit and EITC you could not claim with your ITIN, potentially adding thousands to your refund.
